Hi there I hope someone can advise me . I had a non fault accident on the 28th November 2024 . I came home and thought I was calling go Skippy my insurance firm. Only a month later after been in a courtesy car which I now know to be a hire vehicle. I called GP Skippy who informed me I had been advised spoofed. They wasn't very helpful TBF . I called integrity claims who have been back and forth for the last 3mths ensuring me I won't be liable for the cost as it's down to marshmallow who have taken there time only writing my car of 2wks ago and offering payment. Which I have still not received. They said I have the car for 7 days from receiving the payment. I'm on holiday at the moment and just received a email from my credit report saying I have a credit agreement on it I can't access as not in the country. I WhatsApp the guy whose dealing with it and he says it's nothing to do with them . Evan though he emailed this morning asking me to sign a credit agreement. Please it's the last the thing I need on holiday but where do I stand. Can they take money from my account. I have recently gone bankrupt and don't have no money. When I return I will be telling them to pick up the car . Please can anyone advise. Thank you . I can't believe IV been so dumb . IV countess emails saying I won't be liable for cost for 3months . Where can I go for help when I return to the UK . Thank you

Don't sign anything until you've had time to fully read and understand it.
Usually these things are done on a "no win no fee" basis, so they try to get the costs from the other side.
Normally you are not liable if you agree to co-operate e.g. attend court if needed.
If you really don't have any money then there's not much to worry about (they can't get it from you if you don't have it).
However I wouldn't sign anything unless you've read and understood it.

Hi IV had the car nearly 3months. I originally signed it on the day of the accident in a panic thinking it was my insurance firm. They have sent another one today as it's gone over 88 days but I actually read this one0

Whilst it may be possible to draw some parallels to conditional funding (aka no win, no fee) its a substantially different agreement from a legal perspective as there is a legal basis for legal expenses and success fees for law firms, similarly as there is the subrogation for insurance companies who can step into your shoes by settling your claim but credit hire companies are not afforded any of these principles and so you as the hirer have to be legally liable for the hire costs to enable them to attempt recovery from the third party. Most contracts have convoluted wordings as its a long running cat and mouse game with insurers but generally they will say something like you are liable for the cost of hire however your liability is capped at the liability of the third party - ie if the judge says the £20,000 hire bill is unreasonable and awards £3,000 instead then your liability is reduced to £3k and is discharged when the third party insurers pays up, the remaining £17k is written off.0 -
When I left the UK . They told me my car was written off finally and the 3rd party had made an offer. I was told the car is with me till the money enters my account. To today it hasn't. As soon as the money is in my account then I have 7 days to find a car then the cars go bk .
I have an email that states from December that they are aware I would not be in the country from the 8th to the 21st and it's no fault of mine the claim hasn't been settled and I won't be liable for any cost if the money goes in while I'm away. The car is at my friend's in her drive.0 -
Should I sign the agreement? I'm a 57 year old lady and feel IV been bamboozled from start to finish0

I did read it's quite normal to sign hire agreement s for the car . It doesn't mean it'll cost me as they will recover cost from other party who have excepted liability. But apparently marshmallow are renowned for taking months0
