I need help, this company is chasing a loan that was taken out before 2013, we added it to an iva in 2013, they are saying the loan is secured and was never part of iva but our iva company made payments to mortimer clarke for the whole 6 years we were in it. We finished iva in 2019 and mortimer clarke have waited until 6th Feb 2025 to get in touch with us. Something doesn't feel right.

If it was and is secured then they are correct that it would not be covered by the IVA.
Unfotunately the fee has gone up to £7 but it is worth £7 to see if it is secured against your property

I believe it is possible to include a secured loan in an IVA but I dont think I have ever seen one.
Checking if there is a charge is the first thing to do.
What do you remember about this loan, who was the lender, was there a CCJ on it when you went into the IVA, I am wondering if MC applied for a charge after the IVA started which they should not have done.
is your IVA firm still in existence and have you kept your paperwork?0
