Best Approach? CCA now or wait for LBA

Hi all,

I've read plenty of threads on here about CCA letters and what an LBA entails.  However I can't quite work out what's best.  Either I send a CCA and hope for the best, or I wait for an LBA and put my request in there assuming their process will happen before the debt it statute-barred.

By way of background info, it's a £20k MBNA credit card debt, defaulted in March 2022. The card was started in 2015. Lowells have bought the debt.  Thus far, i've ignored all their friendly, but faintly threatening letters.

In terms of comms from them, they've only just recently offered the first discount (50%) - not sure if that helps those that know what their process looks like.

Any and all advice welcomed, thanks!

You're about halfway to it being statute barred.I would expect them to be able to get a CCA if pushed, and that would be raising your head above the parapet.

I would expect them to send you further letters offering a discount.

Whether yours is an account they would consider for court action is hard to say. I think I'd stay quiet for now
  • ok will do. Thanks @fatbelly - much appreciated.

Can I ask…have you not been paying anything since it defaulted? Thanks

No, I haven't.  Truth be told, I was in the middle of a stress-related nervous breakdown. I had two cards and each of them told me to go and speak to the other to strike a deal and then go back to them, so I ended up in a stalemate situation and couldn't cope with dealing with it any more.
