Hi there, I have PRA calling me for a long time now they bought debt off Natwest years ago must be over 10 years now. I believe payments stopped to them when my DMP was paid in 2019 but this debt was unpaid as I found out it was unenforceable so paid other debt. Am I now able to do a letter to confirm if Statute Barred ? I have had emails with them and I did try getting settlements with them by email and phone over the last few years but I dont remember doing anything by post so am I writing to believe I could send the letter as over 6 years of no letter contact from me accepting the debt? Would love to stop the phone calls they are relentless! they email phone and I get a statement from them in post. just to say I now I answer the calls but say nothing and they just hang up - this way I dont get a voicemail left as when even blocking them or hanging up I still get a voicemail?!

If your sure its not been paid since it defaulted, and that was over 6 years ago, then yes, for sure, send the statute barred letter.

But will it matter if I have confirmed the debt with them after the default by phone or email?

You`re starting to live up to your username lol !!

For a debt to be statute barred in England and Wales there must not have been a payment or acknowledgement in writing for any period of 6 years from the date the account defaulted or was last paid (if applicable).

If your in Scotland the debt becomes prescribed after 5 years, same circumstances apply.

Once you cross that hurdle, the debt becomes statute barred, and nothing you then do can unbar it.

You said it was unenforceable, was that through a cca request.

If it was then if it's statute barred or not it wouldn't matter as it's unenforceable.

There is always a small chance that an old CCA agreement may turn up, also if a debt is statute barred they cant continue to contact you about once you have told them this
