I have a 13 week notice. My holiday entitlement runs from Jan 1st to December 31st. It is 28 days but I carried over 2 days from last year into this year so 30 in total. The contracted hours are 37.5hours per week with no weekend working.

If I was to resign tommorow, what date is my final date at my workplace?

So if you resign on the 5th February your 13 weeks notice starts on the 6th February so your last working day would be the 8th May.

The question of holiday doesn't change when your official end date is however you could request the last days as holiday but they arent under any obligation to agree to it. Similarly you can just ask for your notice period to be shortened but again they dont have to agree. If you leave without having taken the holiday you have accrued it will just be paid out at in the last payment as cash in lieu.

Are there any rules on carried forward holidays? Many places I've worked they have to be taken in the first quarter so the carried forward would need to be used prior to your exit.

Thanks for this. Is it not 9th May?

Yeah the carried over days have to be used by March, I have already had the 2 days approved for use this month.

How many days of leave will I have remaining considering my last day is May?

Well you won't get 28 days holiday, it will be pro prorated to your leaving date. So approx. 10 days.

    Agree it would be 8-May

But your employer should confirm all these details.

Not when I count my fingers and toes.

1.97 weeks holiday, according to the government calculator assuming you dont take any more days. There is however more than one way to calculate holiday so it will come down to your employers methodology

If the answer is 1.97 weeks, then it can't be rounded down, although I guess the employer may choose to make an exact calculation if they want to pay it rather than let the OP take it. That would seem mean to me ...

  • I wish companies would provide the calculations themselves, I've given myself a headache trying to figure out holidays due in the consultation process!  Thanks for the sums above for the OP, helpful for me to read too

Well of course the company WILL eventually provide the calculations: the question will be, are they right?

I've always set out in my resignation letters what I believe my notice period to be, when I believe it ends, and what leave I am entitled to. Then I state whether I'd prefer to take that leave, or be paid for it.

That way, the employer can check MY figures and disagree with them.

But then, I'm slightly anal about keeping my own holiday records. At least, I was while I was working ...
