I’m going to explain the situation very briefly. I was off sick last year a few times, after having a welfare meeting and another meeting to discuss my contract, occupational health, my manager has said that moving forward I can only have one sickness occurrence every 3 months, is this a rule that an employer can put in place?
just to get some context -- how many days and how many occasions over exactly what time period  ?
(apologies if this has been asked and answered)
5 separate occasions, 3 occasions was a 1 day absence, 1 occasion was a 10 day absence and the last absence was 21 days (was recovering from complications from a medical surgery)
Was your surgery elective, during annual leave, or am I confusing you with another poster?

I wasn't clear in my question.

I was trying to establish if you were the poster who asked for help a few weeks ago. My recollection was "took annual leave, had elective surgery, had a complication and was unable to return to work for several weeks". That was you? That's the 4 weeks post-op complication referenced above?

I thought that as well - but I can’t find the thread

34 days over 5 occasions would certainly trigger something under Bradford

I would leave it with the union
  • Just my personal opinion but it does seem unusual to be worrying about how much future sick leave you can have rather than prioritising how to mitigate needing sick leave at all. It can come across like you see sick leave as an extension of your annual leave entitlement. I'm guessing that's how the bosses have seen it and that's why they've lost trust in you working from home because you are making yourself sound uncommitted. Needing adaptations is one thing but telling your bosses you want to know how much future sick leave you can have isn't a great look.

I would just to like make clear that I have not raised this with my manager or discussed how much future sick leave I can take. It is something that I have been informed and was just querying if this is something that they can propose from a legal standpoint of view as they came up with a specific number and I would like to know how they came to that number.

Is it not a case of that if you exceed 1 day per quarter you'll trigger the excess sickness and find yourself subject to formal action again?

That’s what I thought but they never worded it like that. All they wrote was moving forward you will need to limit your sickness occurrence to one every 3 months.

I'd assume it's just poorly worded, but you may want to clarify. Ultimately if you're ill you're ill, but there may be further consequences
