Good afternoon - I received a notice titled “Default Notice under s87(1) of the Consumer Credit Act” but when I flagged this when arranging a payment plan Novuna responded to me saying the following
I can see a Default Notice was sent on X however this was to let you know that you had defaulted on the terms of the agreement. It is sent to make you aware of the action we are able to take on the agreement however it does not mean we have defaulted the agreement completely.
If this had defaulted the agreement your full outstanding balance would be in arrears.
As it has not, your monthly payment of is still due on the X of each month.”
Can anyone advise whether this is a proper default notice?
