Opos Debt Collector HELP

Hi today my husband has recieved a letter from Opos stating they are trying to contact him on behalf of a company called Capquest for a Royal Bank of Scotland ( loan) its for £10,592.72.
weve never heard from them people before or capquest, my husband was in debt when i met him 20 years ago but had a flat and gave that back to the mortagage company who then sold it hubby got no money off it even knowing there should of been over 28K come back to him, he believed all his debts were paid off as he never recieved the flat money and the loan (nationwide loan) he did have was secured on the flat. so if im right in thinking surely when they sold the flat the loan would also have been paid off, and since we havent heard a word from them in 18/19 years. we believed all was paid. we cant think where else a debt for that amount could of come from. with royal bank of scotland. we are worried about ringing them as that goes against the no contact for years and would that restart the debt collecting again. any advice please. sorry about my typing ive got bad rheumatoid arthritus in my hands and im shaking with worry

    OK, Crapquest specialise in buying up very old debts, frightening those who thought it was long gone and hoping people cough up.

    There are the odd cases where they are within time and the debtors reacts quickly and resets the relevant date beyond which the debt would have become statute barred. So do nothing Rash.

    Belt and braces, check the public register for CCJs. Check all three credit records (for free as well). Then report back.

    And just in case, a debt remains collectable even when statute barred, even if it is unenforceable. There's almost nothing they can do apart from writing letters.

    hi Kazz - first of all, dont worry! 

    There are plenty of knowledgeable people on here who will help soon enough, but I wanted to quickly acknowledge your post and to reassure you that this is all easily solvable.

    This appears to be an extremely old debt and if that is the case, it wont be enforceable in court and Opos / Capquest dont really have a leg to stand on, but like I say, the more knowledge peeps will be along soon with more detailed advice im sure.

    Capquest are also well known for 'mistracing', i.e they have bought an old debt, can't find someone who matches the debtor so goes for as close a match as possible.

    You could ignore, but obviously would need to respond to a pre-action letter

    Or

    Send a prove-it letter. There's one in the sticky threads.This explicitly does not acknowledge the debt.

    Given what this debt is alleged to be, i'd be inclined to engage. It will feel good when they give up, though they will probably just move on to the next-nearest match.

    just an up date debt has now been passed on to ACI they are stating it was a royal bank of scotland debt. hubbys swears blind hes never had anything from them. what to do next please.

    Which strategy did you adopt in January? Ignore or engage?

    No reason to change tack unless you get a letter of claim.

    So if you are ignoring, continue to ignore.

    If you are engaging, you just send a prove-it letter every time someone new writes to you.
