All,

I urgently require some assistance. I have gone through some threads but cannot find what I'm looking for. So I've had a bad hand. Been going through divorce and custody since 2023 and in 70k worth of debt.

Virgin sold debt to Lowell.
Capital on tap sold debt to shire recoveries.
Mbna/ Barclays are on Hold.
Hsbc have sold debt to someone I need to find the letter.

So I used these CC to pay lawyers and pay for day to day living. Now debt agency are sending me letters to contact them. I spoke to Lowell who have put my file in hold.

Shire, whom I spoke to today want me to fill a financial form, however upon reading , I don't think I will.

I suffered loss of income, Los of job and went into depression (come out of it now) , didn't work for many months and went on UC which I am still on. (Hopefully start work next month as I'm trying to get back on my feet moreso for my children).

How do I put a stop to the calls and letters from Lowell and Shire. I definitely cannot afford to pay them as I'm barley keeping with utility payments etc. I own nothing to my name, currently not even a car due to my circumstances. I avoided many letters previously but speaking to shire over the phone today they were extremely aggressive.

I was not informed that debt was sold on. What legal merit do these companies have to collect debt? Is there a letter I can send to them stating I want informed that debt was sold to them, I cannot pay? Any legal advice . I do not want to do a Iva or go bankrupt as I'm only 33. I am starting work again , but still have a uphill battle with lawyer costs and renting. Family helped me as much as possible, and I just want to see my children (2 of them, I see one weekly).

Please can someone assist.

    It is covered in the CC T/C around debt being sold on. There is not need for you to be informed on this.

    I think what you might be looking for is a debt management plan.  If you go to one of  the debt charities (StepChange, NationalDebtline, Community Money Advice, CAP or CAB) they will help you deal with the debt collectors and put together a financial statement for you so the creditors know how much you have available to pay them.
