    If the employer is annoyed by bro appealing a neutral reference could turn into a (truthful) negative one
    Wait a second I'm not appealing for him..I merely gave some input as to what he should include in the letter which he will send under his own name only.

    I sent an email to HR to see if they were open to a chat as his next of kin. They haven't responded so I'm not going to push it any further. 

    Now I'm sure all can surmise if you don't hear from me furtherthe appeal hasn't been successful and this thread can now be closed (@mse moderators).

    For future reference, although I’m sure you meant well, that was a terrible idea. Next of kin has no legal meaning apart from as a point of contact when someone is in hospital. The employer has a duty of confidentiality towards their employees and the HR department did the right thing in not responding to you

    I can remember some years ago when I was off work with depression my mother, unbeknown to me was discussing me with my line manager. I was absolutely furious that they thought it was okay to go behind my back and talk about me without my consent. Still makes me cross now.

    Well I messaged his line manager asking for feedback and he gave me the Hr email address to contact so that's what I did.

    Well that is the easy way for the manager get the problem off his desk!

    It doesn't mean that the hr department will engage with you, as they most certainly shouldn't without your brother's written consent.

    I can only echo elsien's excellent comment in their post above yours. You have been given excellent advice in this thread. However, as it clearly isn't what you want to hear you seem determined to ignore it. I see little point in debating the matter further.
