Hi there

I’ve been browsing the newbies forum though am unable to find the response which suits my case best. The threat is from UKCPS and states:

”1. The Defendant(D) is indebted to the Claimant(C) for a Parking Charge issued to the vehicle -

at Central Car Park

Manchester M1 2EG. 2. The PCN was issued on 13/02/2024 on land managed by C. 3. The vehicle was parked in breach of the Terms on C's signs (the contract), thus incurring the PCN. 4. The driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests the PCN is outstanding and has escalated. AND THE CLAIMANT CLAIMS 1. 170.00.being the total of the PCN. 2. Costs and Court fees.

The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 03/06/2024 to 09/12/2024 on £170.00 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.04.”


Could anyone please help me out as to what to respond following this debt letter from the council? I have acknowledged it already but need to draft a defence. Thank you.

    If it is from a council, you need to go to https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/
    If it is not council and is a PPC, then go to the NEWBIE sticky second post.

    You appear to have received a court claim. What is the date of issue of that claim? You need to complete an acknowledgment of service then submit a defence within specified timeframes otherwise you will get a judgment in default. 

    The Ts and Cs on the signs that form the contract at the site will state something along the lines of, by failing to comply with these terms and conditions, the motorists agrees to pay the parking operator £x. It's called an agreement by conduct, and I believe is already explained in the sticky Announcement for NEWBIES.

    Read the guide to court written by bargepole that you will find in the NEWBIES, as well as the template defence sticky Announcement that covers your case perfectly.

    Use the template and show us only the parts that you have changed. You should include the references to the Chan case. 
    Once complete and the regulars have had the chance to look at your amendments, submit the whole defence by email as per the twelve step guide in the template defence sticky thread.
