Decree/debt/gambling

Hi, looking for advice. I have not paid my debts in 5 months due to health reasons being out of work. I have defaulted on every credit line which all racks up to £41,000

I have had issues with gambling because of lack of funds which I have now gamstopped but still have transactions from last month and don’t know if i will be accepted for a DMP(DAS) in Scotland. Can anyone help and how long before I get court action taken against me?

    Hi Jester. 

    First of all welcome. I'm also in Scotland. If all your debts are now defaulted you can set up debt repayment plan. Previous Gambling should not affect this. Have you spoken to step change? I stopped all my payments to my credit in Nov 2023 and defaulted on all now...I'm only just setting up repayments now. You will get letters and calls, but not a lot else to start. I assume you are up to date on essential bills like council tax, mortgage/ rent as these are treated differently for unsecured debts. 

    When I started out speaking to step change was so helpful and made me feel better. I feel now over a year in. In control and I can actually sleep. 


    Debts Jan 2024 : £105000!!eek!!
    Debts Sept 2024 : £81000
    Debts Oct 2024: £73600

    Hey! Thank you SO much for your reply I really appreciate it.

    Yeah I defaulted on all creditors last month. I have spoken with Step change and they’ve said to apply for a DAS online but I’ve had issues with bank statements because I moved bank in December so need to wait for my old bank to provide me with them.

    I stay with my partner and all bills are in his name and I give him money every month. With me being in and out of work I’m worried the DAS will get rejected because of the unreliability of my income as well. 

    I just don’t want a decree( CCJ in England) to happen and I’m really stressed out

    Hi. I'm glad you have spoken with them. Debt collection is relatively slow and if your dealing with step change they will give you a number to quote to your creditors. There is little they can do if you are taking advice. 

    Not sure about the income part for a DAS I was going to do one, but decided to go self managed. I hope it all goes ok for you. I suppose the other option would be a debt management plan is DAS didn't get approved. I would of thought Step change would not of recommended it if they didn't think it was an option for you .

    Just checking OP - by defaulting on your debts, you mean that they have all now formally defaulted you, rather than just that you have stopped paying?
