    Thanks, I filled out the AOS last week. 

    When you say it is not pleaded, I have followed the 'do nothing' until the court claim arrives, except for the previous response sent on this thread. Is there an action I have missed?

    I am going to write my Defence starting from today, should I start a new thread?

    The company who were issuing tickets at our club car park have been removed and a new company put in place around the same time I received the tickets through the post, because of this I do not have any photos of the car park and their signs, is this going to be a problem? May be that the club house owners have some photos of the setup, but they werent very helpful in the first instance so I am not expecting much help there.

    Also, in the defense notes I am reading, it mentions "CEL (in-house only)" - Are there 2 CEL's I need to be aware of? What does the in-house only refer to?

    Once you have completed the AoS, it is, as you write, time to compile your defence using the new template but do not start a new thread.  If the breach is not pleaded, it means the reason they are chasing you is missing from the POC and you can use the defence that includes Chan & Akande.  CEL sometimes do their own legal stuff (in-house) and this can be seen from the Claim Form.

    - banning DRA fee add-ons completely

    - making sure a new SINGLE appeals service replaces POPLA and the IAS which are seen as not fully independent and involved in a 'race to the bottom'.

    We are discussing how to respond. The issues above are the IMPORTANT ones. Personally, mainly because it means the Code will come in quicker (no signs will have to be changed) I have no issue with PCs 'up to £100 cap' AS LONG AS DRA FEES ARE BANNED.

    I have taken the most recent slimmed down defence that is edited for MCOL, if part 3 is my part to write and it is suggested to use the CEL v CHAN paragraph, am I just pasting the entire pre written defence along with the CHAN paragraph in part 3 and that is it?

    Part 2 I am just leaving as registered keeper. This is a car park where you have to walk up to the club house and tap your registration in, honestly cant even remember whether this was put it incorrectly or was forgotten being so long ago, its used regularly. I have multiple drivers on my car also, does it matter whether I was or was not the driver for the copy paste defence + chan paragraph.

    Hmmm but obviously add this too:

    And the Chan and Akande wording is usually two or three paragraphs, not one. Read a few recent defences to find it.

    Delete the final paragraph of the template defence if you need to, in order for your defence to fit in the MCOL box. The last para is optional if you have a longer facts section.

    Don't forget to 'SUBMIT' it.

    And don't forget the Consultation.

    Yes,  but remove the word I, and You etc

    Replace with,  the driver , so possibly this  ?

    This is a car park where the driver must walk a few minutes to a club house to type their registration in, so the defendant cannot remember whether this was typed incorrectly or was forgotten being so long ago, it is also used regularly by multiple drivers of the car so possibly wasn't the defendant

    Could replace the possibility that this was a typo with the more likely scenario that it was a faulty keypad. Look at all the recent press articles about these faulty machines!

    I submitted the Defence on 25th July, was noted as received the same afternoon on MCOL.
    I have been away this week and back in a few days, will anything come through the post that I may miss that needs dealing with in response? I have family with keys who just carried an A4 sized letter into the house, just wondering if I need to get them to open it.
