Irregular or regular hour employee

Hi,

I’m hoping someone can shed some light on whether I should be considered as regular or irregular hour employee. My employment terms state: Your normal hours of work will be 10 hrs per week excluding all breaks. In accordance with your availability, as agreed with your manager and as confirmed in writing, you will be required to work reasonable hours during all seven days of the week, late nights, public holidays, excluding Christmas day. You will not be expected to work more than six days in any seven-day period. You may be required to work additional hours, as may be reasonably required. You wiIl be notified of your working hours and days via the weekly team member's rota. Ect…


Does this make me an irregular hour employee as although my contract states set hours but also I am actually working different hours every week?

    For what purpose are you trying to define it?

    The most common definition is if the number of hours you do changes each pay period, it's not generally related to when the hours are worked. 
  • Hi, I am wondering because my employer started using 12.07% method to calculate my annual leave entitlement which can only be used for irregular hour employees.

    Your annual leave is normally based on your hours - which you know. If you do regular extra hours then your annual leave is calculated on the average weekly hours worked calculated over the last 12 weeks

    No annual leave is calculated over last 52 weeks average hours, however, this not what I am trying to find out. Thank you for trying to help though
