Panicking

My partner went to cap over a year ago. They took all his info and suggested an rva, however they then said they were too busy and refered him to moneywellness, however over a year later we are still waiting. They keep asking him to upload more info, now the cap referral is out of date and all the time the debs keep growing, its causing us huge mental strain. We want to move in together but im terrified of having his debs attatched to my home. Please help

  • Does he own his own home, have a mortgage?

    If neither of those why was an IVA suggested?

    His debts would not be attached to your home and as long as you don't have any joint accounts you will not be connected to him.

    Has he been paying anything to the debts in the last year?

    If not has he been saving an emergency fund?

    The answers to those questions will enable us to give advice

    Debts attach to an individual, not a home.

    I think you meant IVA. Not sure if CAP do them, so that might make sense. If that hasn't been set up yet, he may have dodged a bullet. Most are missold.

    The way forward is to post a statement of affairs in his new situation, and let us have a look at it

    Could you explain why the debts are still growing, surely they must have defaulted now after a year of non payment??

    Much more information is needed to advise correctly.

    Does your partner have much spare income each month, or a car worth more than 4000? I am wondering if CAP referred him to Money Wellness for a DRO rather than an IVA.

    Check if there's a Community Money Advice team in the area.  Sometimes they have availability - but they're less well know but still a charity.

  • Hes in private rental, rent is £980 pcm. He works full time earns £1600 pcm.
    Has part time custody of his kids. 
    All debts amount to over £20,000 some due to being homeless and setting up home for the kids, all have defailted while waiting for cap. 
    Cap referral was because nearly a year of waiting and they didnt have time/ staff to finish it. 
    However, im in social housing and work part time, care for my mum with dementia, and have a child. It would mean him amd his kids moving in here and me losing my universal credit top up and financially we would struggle especially if he still has these debts. I dont want debt collectors at my door, theres no way of proving whats mine or his once hes here. 
    Money wellness are now suggesting a dro, if cap will re refer him as its taken si long all the info is out of date and obviously this also means another year before he can move in!

    Yes it doesn't sound like an IVA situation - more like a DRO.

    Both CAP and MW can do them. He just needs to pick one and go for it.

    There's no particular reason to wait 12 months to move, though clearly once you are a couple for benefit purposes there will be a lot of change.

    Most debt collection is done by letter. I doubt you would get any visits. Once the DRO is in place all action is frozen. There are only a few debts that survive a DRO, like fraudulent debts, criminal fines, tv licence arrears
