When to resign under 2 years and at without prejudice discussions

I started working at a factory in January 2023 through an agency then contract July 2023, I was assaulted 3 times and he was sacked, my line manager failed to take it to Hr since then the line manager has constantly harassed me been ongoing for a year, It's left me off work with mental health, I've had Hr meetings, grievance, outcome and appeal, acas are involved and I've put a claim for victimisation, I'm now in a without prejudice discussion through Acas, my main question is when should I resign as I'm under 2 years employment?

    Why is 2 years significant in your decision to resign? Two years employment is significant for the additional employment rights it gives the employee and additional legal obligations it gives the employer but even then, an employee can resign at any time as long as they give either the notice required by their contract or that required by Statute, whichever applies.  If you need to resign to protect your mental health, do so. It's possible that resigning might affect Universal Credit but if you have evidence that you could not reasonably be expected to continue to work for that employer you may not be sanctioned. In any event, if you do resign without another job to go to, you should still sign on as unemployed so that you get National Insurance credits, even if your Universal Credit payment is sanctioned for a time.
