PRA CCA response

Hi all, a month or so ago I requested a CCA from PRA for BC. Didn't hear anything, assumed they had not found anything. This week they wrote asking me to confirm my name, DOB and address, I replied to them on Monday with the information that they already had. They then said they would put my request through and account was on hold. Today I received an email with an attachment of my default notice but nothing else and no mention of anything to follow. I assume they are still trying to find CCA (from 14 years ago) and trying their luck with this? I've read PRA will try every trick in the book with reconstituted CCA's etc.

They were ok with me and after three months wrote to say they couldn't obtain the paperwork. They have since sent various letters trying to get me to pay, details of a discount offer in big text at the top, and then hidden away in tiny writing in yhe contact us section they say its unenforceable.
If they don't provide the cca within 12 days of you asking for it then the deht becomes unenforceable until they do. I'd stop payment and ignore them completely until they do send the cca.0 -
Thanks Rob, haven't made any payment to them as of yet. The debt was sold in September and as soon as they made contact with me I requested the CCA but they said they needed more information before requesting it and asked for my name, DOB and address. I replied with the same name and address you have written to me at.
I do also have an irresponsible lending claim with BC at the moment so I hope this won't affect it as they could turn around and say it's enforceable as I acknowledge the debt due to my irresponsible lending claim with BC. Not sure how much BC and PRA actually communicate with each other. They have already offered a 10% discount but am hoping to get it much lower then make a F+F offer.0 -
To take any legal action against you they need to be able to produce the CCA, if they can't produce that then that's it, it doesn't matter if you have acknowledged the debt or not. If it has become statute barred then you can use that as a defence if the CCA can be produced. It will only become statute barred once it has defaulted and you haven't acknowledged it for 6 years. Making an irresponsible lending complaint would acknowledge the debt and delay it becoming statute barred. It sounds like it has defaulted recently so that shouldn#t be too much of a concern at the moment.If they can't produce the CCA then there's no need to pay anything at all. I'd press on with the irresponsible lending complaint and completely ignore PRA unless they produce the CCA.0

Thanks Rob for advice again, today they have sent me statements saying back 15 months. Still no CCA. I don't know if they're just sending me things in dribs and drabs, surely they really only need to send CCA rather than statements and letter of default. Obviously cannot find it (yet!)0

Hi.
I'm also in this boat, received letter ages ago saying they didn't have cca. However yesterday received a bunch of statements via email. No explanation from PRA group just saying it was the information I requested which it's clearly not. Just choosing to continue to ignore the request. Hopefully this is just them trying scare tactics

Theae companies do try very hard to try anf muddy the waters. PRA sent me a "factsheet" about CCAs whixh mentioned it couldn't be enforced once and tried to brush ot off as a technicality and then listed five things they could still do which it went into lots of detail about. I had another one where they couldn't find the CCA but said the debt was *valid and repayable" to try and make me pay something.
Unless they sent the CCA itself then juat ignore them.1 -

Had another email today saying following our conversation your account is on a 7 day hold...laughing as I have had no conversation with anyone and my only correspondence was my cca request to PRA group ... So yes I will ignoreDebts Jan 2024 : £105000!!eek!!
