Recieved 14 day Judgement Notice

Hi. I have a debt of c£7k with a credit card company and c£5k with another. I've just received a notice that one of them has applied to court for a CCJ against me. I'm terrified as that would leave me in tatters financially. I was diagnosed with cancer last year and although not terminal, it left me anxious and unable to work for the first few months after diagnosis.  I'm slowly getting back on my feet but need help to avoid getting a Judgement. Can anyone urgently assist?

  • A letter sent by snail mail?

    If so you have to deal with it now, if just a text or E  Mail then it is an empty threat.
    If you go down to the woods today you better not go alone.
  • Received by mail. I need to delay any proceedings as I'll need time to try to raise the money.

    What have you received, a county court stamped claim form or just a letter threatening court action ?
    If the former post up the issue date and someone here will talk you through responding.

    If its got to this point surely its too late for that, companies dont start threatening CCJs for one missed payment, how far behind are you?

    Also CCJs paid within one month of being issued have no lasting impact.

    A typical misconception with court debts is that they must be paid outright, and forthwith.

    When in reality if you receive a forthwith judgement, you can apply to the court for an instalment order, to pay the balance monthly, at an affordable rate.

    Respond to the claim, fill in the income/expenditure form, and make sure you return everything within the timeframe, any potential payment has to be affordable to you.

    I've received the papers from the Court dated 30th October and I received it on 6th November.

    Missed payments since March/April this year. Tbh, I've buried my head, wondering whether my diagnosis was terminal and/or had spread, due to other health issues.

    A CCJ leaves me unable to keep my small  business afloat. I prioritised essential payments (business insurances & rent) to these CC debts.

    Unlikely, but paying the CCJ amount within 30 days effectively removes it.

    Does that buy you enough time?

    Did they not send you a "letter before action" (LBA) as per the civil procedure rules?
