Child MAINTENANCE SERVICE (CMS)

I am starting this thread to find out how many fathers / mothers have been duped in the same way as one of my clients who has been asking the CMS to review his forced payments since 2009. I will let you have all the information and his journey on this thread, if I am allowed to continue. The treatment of my client is no way to treat any father/mother who have gone through a tough divorce and consideration should be innkeeping with the way this agency should be relating to the Equity Act 2010, they claim they adhere too.

They appear to be an organization in serious crisis and disarray, I escaped the system worse off than I should have been as they took 17 months to process a valid expense (it was approved) by which time circumstances changed and our children swapped primary carers. It was enough to put us off instigating a new claim because the system is fraught with difficulties.1

The way the award is calculated and the fact that CMS don't take extenuating circumstances into account has resulted in my son having to sell his house. He has supported and cared for his two daughters all their lives and the eldest is now, in full-time education. For the past 7 years there was 50/50 shared care apart from 22/23 when his eldest daughter chose to live with him full time. After a year she returned to her mother and 50/50 shared care. Last year things broke down and the girls decided to live full time with their mother. Rather than accepting a reasonable amount for their care (as he had done when the eldest lived with him) mother took it to CMS and they have awarded her an extortionate amount meaning after paying his mortgage, bills and loans my son has nothing left to live on. He contacted me yesterday to say he can't manage this anymore and needs to put his home on the market. Well done to the master manipulator and the CMS! The way the amount is calculated is utterly irrational and destroys people's lives. People have taken their own lives because of this. We're not talking here about children who would otherwise be living in poverty, were it not for mother being awarded a vast amount of father's income.
The children have wanted for nothing. Also mother has her own business so not living in poverty. The cost of living is high for everyone, including the rejected parent but CMS don't care about that. This is how people end up homeless!
Sooner the CMS is dismantled (like CSA it's predecessor) the better. Let them all go and find a different way to pay their own mortgages and bills!
