Letter threatening home visit to ‘establish my residency’?

Hi, currently dealing with various creditors having let debts slip into defaul

this letter has come from My Community Bank..(Town and Country legal services) and relates to a loan

any advice on how to approach, seems to be way of spooking me a bit as there is nothing they can do by visiting, should i even talk to them. Generally speaking i would rather avoid home visits due to kids etc but if they have to happen then so be it

  • This is meant to scare you into paying the what they want.

If anyone does knock at your door you can either ignore them or tell them to go away without answering any of their questions, they are no different to a salesman knocking at your door.
If you go down to the woods today you better not go alone.

Take the same approach that you would with TV Licensing

    'Who are you?'
    'TV Licensing'
    'No thank you'

MCB can be aggressive but they are just another nonpriority creditor who lend to people who are already struggling

cheers, so to be completely clear they have no powers at all (its only court orders that you need to worry about on this front right?)

Would it help if i explained to them its not my home (belongs to my partner) or is it best simply
    not to engage?

Having said all that, you need to decide on a strategy for dealing with your debts, quite soon.

Have you considered an affordability complaint?

People expect credit unions to be 'nice' creditors and it is not true. Those that charge high Interest can build in some flexibilty for people who can't pay. Credit Unions can't do that

What "powers" do you think they might have lol?

Just because it involves money doesn't mean they have any special powers, they have exactly the same power as you or I do, or indeed the religious people that knock on your door wanting to discuss Jesus with you.

The best stance to take is to not deal with them at all, you don`t want to be discussing matters of a personal nature with a stranger, so if they call, inform them you will only deal with this matter in writing, and ask them to leave, don`t let them in, and if they get funny, threaten to call the police or film them.

The laws of trespass apply equally to such individuals that are not welcome to call.

No need to deal with the "visitor" but you do need to deal with My Community Bank.

They are much more likely to secure their debt through legal action than a normal creditor.

Do you have other debts? How are you intending to manage them going forward? DMP, DRO?

Have you been in touch with a debt charity? If so, let them know.
