IVA has been terminated with debts outstanding... Help please!

I entered an IVA in January 2022 with debts and a CCJ of around 26k. This was with The IVA Advisor, who have since gone into administration. It was passed to Anchorage Chambers.

I struggled to make payments and after doing a lot of reading, I don't think I should have had an IVA anyway. Anyway, it has been terminated now and they have given me the certificate of it and final balances.

Just in the last week I have been told I was overpaid UC in July, and also highly likely Carers Allowance as they have asked me to submit a form. I earn chuff all and most of my money comes from DLA and the carers. I am pretty much in the 'deep'.

Mental health is also a big factor and everything seems to have happened at once which is overwhelming.

Could anyone kindly advise me on my next steps please?

  • Just adding CCJ is from 26th Oct 2020... This is from a miscommunication whilst using StepChange.  I think it is from PRA Group.

    Make a list of who writes to you and how much they say you owe.

    It sounds like a couple of DWP debts will be on their way.

    The IVA debts should have received some payment but you will be surprised how little. You also may find the creditors going in to the IVA are not the ones you have now, as they change hands.

  • Firstly, don't panic. I had an IVA terminated in 2019. I have only ever had minimal contact from any of the creditors in the last year and my debts will be statute barred in a couple of months time.

    It sounds as though your income is solely or mostly from benefits so a DRO might be suitable. More info will be required to get the right advice. Collect up all the letters that come from your creditors and compare them to the balances given on your termination certificate.

    You will need to work out a budget and first step is to complete a SOA. There are more knowledgeable people here than me who will be along shortly to advise.
