My brother has BTL property he has never lived in. He is selling the house he has lived in (Main Residence) and buying another house be his Main residence. Two questions;
1. Because he is buying second house (as he still owns the BTL) does he have to pay the higher Stamp Duty?
2. Would he liable for CGT on the gains of selling his main residence?
Thanks

And no.
So long as he sells main residence and buys a replacement main residence there is an exemption / relief available.
No CGT on main residence so long as it always was so.
There have been a couple of threads about the SDLT in this scenario - I will try to link one. It seems as though Solicitors don't always get this correct.
