TUPE and mileage rate

Hi

My new employer has implemented a Car Allowance as part of my compensation package instead of a Salary uplift in the same year. The Car Allowance has a policy attached to it which requires me to use a lower mileage rate (18p/mi), previously I used 0.45p/mi and I had a salary which include a Car Allowance with my previous employer.  I'm still on my TUPE'd previous employers contract (so this hasn't changed).  The change to a lower mileage rate has a significant negative financial impact to my annual earnings (I have to travel to site a lot as part of my work).

Question I have: is my new employer in breach of TUPE Regulations?

    How did things work prior to the transfer?
    What does your actual contract state? Something vague like "in line with company policy"?

    TUPE is 99% about ensuring your continuous service isn't impacted by the transfer. Almost anything else is easy to deal with for a basically competent company and foresight.
