good morning all,
i recently recevied a letter from Moritimor Clarke stating that they are going to apply for a CCJ on a simply be debt.
i was in dispute with J D William (Parent Company) at the time and had a successful claim for unfair lending and balances reduced by the FOS but J D william wouldnt play ball with a payment plan i had set up so i basically ignored it and just got on with life, now have rebuilt my credit and managing my money better
have checked my credit file the account was closed by Simply Be in december 2018 missed payment april 2018 arrangement to pay March - Aug 2018 then september and october report late.
Debt was sold to Cabot who report the default date as 18/12/2019 - trying to work out if the debt is status barred or do i have to deal with Mortimor Clark

Cabot own the debt, Mortimer Clark are their tame solicitor, the threat should be taken seriously, as the account won`t be statute barred until next year, unless you live in Scotland, do you?
The payment plan would have been acceptable to Cabot, and still will be if presented to Mortimer Clark, thus avoiding a CCJ

I assume that means you will be sending them a CCA request.
You don't say how old this is. JDW were very poor at bothering with formal agreements until about 2008 and even so may not be able to find an old one to give to Cabot.1 -

The agreement with JD Williams was around 2015/16 as usual credit limit went up every other month untill I was just paying over £300 a month in minimum payments.
Got made redundant set up payment plan with them, then they kept saying they hadn't received payment then had to send them proof each time and took weeks to sort so got so fed up said stuff it and ignored it.
Will of course be sending a CCA request to JDW and will be telling the debt collector's that I am doing so1 -
