Applied £1 CCA fee to account

Hi all, Started my journey about 7 months ago and starting to get defaults now. I've sent a CCA request Ardent Credit services for a next account that is now in default. I've had a letter back from them today saying they have applied the £1 to my account and not acknowledged the request at all. Where do I go from here? I used a template letter from Debt camel and I've used it before for Barclaycard account now with PSA. They returned it and am still awaiting CCA details (if they can find it) but Ardent seemed to have ignored the request and cashed the £1 PO! Any advice greatly appreciated

    I'd follow it up with a complaint that they have gone against your express instructions, that the £1 was not a payment but only to be used for a CCA request.  Furthermore they need to correct your account to NOT show this as a payment and provide the CCA and if they don't want the £1 for the CCA request that they are required to refund it immediately.

    As above, issue a formal written complaint to them, advise that the £1 payment was the statutory payment due under section 77/79 consumer credit act for a request for information, and was not a payment to your account.

    Until they action this correctly, your account with them will be temporarily unenforceable due to their error.

    It used to be an old DCA trick in order to get you to acknowledge the debt by payment, but in this case its more likely to be ignorance or sheer incompetence that is responsible.

  • Thanks, will do. I vaguely feel like I remember reading it on other people's threads when starting my journey that occasionally they do this. I've also asked them to update my address, which they keep ignoring too. Can't seem to find many posts on people who have dealt with Ardent, though. 
  • Sorry, just another quick question. Ardent acknowledged the complaint and refunded £1 but still no mention of CCA and still hounding me every day with calls, emails and letters. In the acknowledgement of the complaint they didn't even mention about CCA, just refunded me, it's like they're ignoring the request. PRA also still writing occasionally, however they did acknowledge that they had received request and would contact me. I still get collection emails/letters from them. Would you contact them again reminding them of the request or just leave it for if they try and threaten further action? TIA
