  • Hi Sammy, that's great thank you. I have spoken to Stepchange and they said CCJ's should look to be cleared in 3 years which I would not be able to do so that was my concern really. It would probably take around 25 years to clear the CCJ so just wanted to know if that is possible or if they would force me to sell the house or can they force me to sell the house?

    A charging order followed by an order for sale is a really rare beast.Only a handful are seen each year and these would be on properties not needed by the debtor.

    It's a possibility in the same way as being killed by an asteroid colliding with the Earth is a possibility. Not one to worry about

    Ps Stepchange made that up. Ask them where it appears in the legislation.

    So a monthly payment on a large CCJ over a lot of years even is still possible? Say 20 years? £150pcm per month.

     Is it possible to pay a chunk of the debt and also pay monthly?

    Sorry about the questions this last month I’ve suffered really bad anxiety and having a clear picture is really helpful.

    OP, they can`t take what you don`t have, your starting point should be that you can do anything you want to do, no one can force you to do anything, and what exactly does "aggressively pursued" actually mean?

    Letters and calls is deemed to be collection activity, in a nutshell, bailiffs can only be engaged after a CCJ is granted and you fail to maintain payments, payments can be as little as £1 a month or even nothing, if that is all your budget allows, courts do not make orders for unaffordable amounts, no matter how long the payments will take.

    Use the common sense approach and you won`t go far wrong.

    Thanks Sourcrates. I had read business debts are more aggressively pursued so I thought that meant house repossession or bankruptcy. 

    It was stepchange saying paid off in 3 years that threw me. I don’t disagree I owe the money and need to pay back but I would just need time to
    pay and it may take 20 years unfortunately!
