Help. Newbie. QDR letter on PCN (Europarks,Shell)

I'm afraid I am late to all this wonderful information. In stead I sent snarky replies and evidence to every letter I got.  They pretty much ignored it. What's really surprising- it that now I have contacted Shell thingking they would make it go away- they;ve. said sorry there is nothing we can do go through the appeals process. What an absolute disgrace. I mean it's a low level c.service reposnse- I've said I'll escalate it but it's such a waste of time.   I have spent a year on this- and it's been such a watse of time but it's just not fair to let them take advantage of people and hope they give up.

Long story short. I was on the forecourt needing to charge my car and the e charger didn't work. I didn't actually. see the time limit thing but that's beside the point. I was really stressed because I would havebeen stuck. I went inside and importantly the clerk didn't offer to take my reg down (I note this because a few months later my battery went flat and the same garage's clerk said he would take my number plate so I didn't get a ticket). He told me to call customer service. I did, it still didnt work for gaes- but eventually did and I charged my car. Noone else tried. to use it while I was there (nor could they because it wasn't working). I sent evindece that I called customer service, and the time the email confirming the account with the chrager came through- about 10 mins before the time would have been up. I told them it still wasn't connecting. Thet said I had provided no proof I was a customer and that I coudl appeal and that was that.

I spoke to POPLA, they said to write back to them.

I wrote back with information that the phone number was to shell custoemr service.

They said I no proof was included and my appeal time was up.

I spoke to POPLA and citizens advice. And they both said that wasn't right. POPLA told me they shoudl have given me a new POPLA. number for me to appeal with.

I wrote back.  I quoted a lot of law, quoted the PoC, some government ministers and the goods and servcies act. I quoted my email from POPLA. I then sent to  BPa who were beyond useless annd told me to "follow the appeal" I told them they weren't allowing me and they were pathetic. They said I shoudl have 28 days from the last appeal.  I quoted them and POPLA.

They didn't reply. I then got a letter from Debt Recovery. I wrote snarky letters quoting harassment laws for motnhs. They ignored my letters for months while sending boiler palte letters saiyng "you have ignored out correspondance", "you have had a right to appeal" " you were guilty of violating parking rules" etc.

I proved they were wrong on every count and kind of enjoyed doing it.  Eventually they replied, Threatened me. I threatend them with court right back and said great- Ill see you in court. They gave up.

They sent it back to Europarks- who tried again- I said absolutely not!

I told them that I was very sick at the time- and not at home when they sent their letters. All true. and I told POPLA when I called them. And put that in an earlier letter.

I also said that I suffer from a chronic illness which is listed on the Equlaitie Act list of illnesses under protected characteristics and disabilities. 

I pointed out that a grace period has to be allowed. That a grace period was not pointed out on the PCN. That for disabilities (which is defined by law not blue badge holders- whic you cannot demand becasue that is a violation of privacy and personal dignity- this is different to me using a disabled parkign space without a blue badge- I would have to ask for a badge if I want to do that) you are supposed to allow more than the alloted time- for 60 mins 120 is normal. That the grace period is also normally double. 

I used your guidelines on the newbie links and said that I require the contract with the landowner, who the landowner is etc and the agreement of the fine reqiuestedm the agreed rtime and the agreed time for disabiliteies and vulnerabilities as defined by the Equalities Act, and what protocols. are in place for those to be poitned out to staff should assistance be required or after the fact should a ticket be issued after the fact.

I asked for evidence that they have locence to get. data from DVLA.

I sent this to QDR who are acting fro ZZPS. Eye roll- and said I require this regarding, QDR, ZZPS and Eurpoarks respectively.

All I got was an eail asking me to verify my address an email address. And the email flags as unsecure and unveririfed. So I've said no. Thisis suspect. My address is on the correspondance I have forwarded to you. I am sick and you are making this unnecessarily complicated. You can post to me recorded delivery if you wish- that is how you reached me before.

I am stunned that Shell have said we're happy with our repsonse.

Can I go higher up? And say you're abusing vulnerable people. I've told them they're breaking them law.

And what do I do now?

I don't want it to go to court. If I did lose- I volunteer as charity director for 3 charities. And I have just set up a charity. That whole chunk of my life would be over if I have a CCJ.

I told Shell- this is totally within your power- it was your machine that did not work and I sent them receipt for 21 quid I then paid. I'm really disgusted.

I used a lot of your wording from court filings you uploaded for the ltter to the solicitor.

I hoped one or both would be silver bullets.  I'm really sick. I'm behind on work. i'm about to go away for work for 5 weeks and I don't want bailiffs turning up while I'm not here or letters to appear that i miss. I'm justtoo tiered and too behind for this. I'm self employed so everything falls to me and I can't keep takign 2- 3 hours to do this....

Here is the VERY long letter I sent the solicitor- to Shell i sent this with the evidence and a screen grab of their "comitment" to inclusivity and access. 

I told them their CCJ threat isuselss- coz what do they know?

I'd really appreciate guidance on next steps. (Sorry for any typos- not well today)

No need. All these cases are the same.

There's no such parking firm as Europarks.

We know you mean Euro Car Parks and the so-called legal firm is DCB Legal.

Just email them the recommended LBC response which makes them put the case on hold for an extra 30 days which will get you past your time away, just.

There is no danger of a CCJ affecting your future, as long as you follow the process described on here, even if you lost in court you would simply pay in full ASAP 

No bailiffs will be turning up, your imagination is in overdrive, reign it back to facts, not fiction 

Is it Euro Car Parks. ,  ECP. , ?  Or Euro Parking Services ? Or some other similar name. ?

Hi- Just saw this. My lap top packed up of all the timing.

You're right it is Euro Car Parks.

Their solocitor kept emailing saying I have to verify myslef- ha.

I told them where to go. And that they had all the information they needed and they were violating the law by requesting it. I'll see what they say. they need to ask for somethingbefore I ask for 30 days- they haven't actually stated anythign new yet-ot threatnede court just that it may got to their litigation if I don't respond

(There emails always come up with an alert saying it isn't secure and is coming form a box that is not from the sender...) So  I told them that and quoted gov. cyber crime saying never answer a solicitor asking you to verify yourself in an email and tell them I am reporting them to the cyber crime unit and a judg wouldn't look kindly on bullying and coercion which asks you to go against gvt safety advuce. Shrug

Just send the LBC response and if they want data verified just do it.  Perfectly normal.

Um. I am calm. It's not perfectly normal at all to send verification to an anonymous email. I work in cyber and that isn't something you should be telling poeple, I'm afraid. The previous advice was to ask for 30 days debt advice, to buy time. I've told them I don't owe it and have asked for copies of their contracts etc according to all the advice on the newbies links. They have my address on the letters I scanned- and I used the correct reference numbers.  I've sent about 6 letters before action to all the previous parties who gave up and passed it back, including ZZPS who have asked QDR solicitors to take it on. I sent the solicitors a letter stating my case, the relevant case law, and requesting all the information as claimed and saying I'd take them to court, with a Cease and Desist. This is essentially an LBC. I've told them I'll see them in court. I'm not sure how that's different at this stage. I've said Letter before Action for nearly a year.

But they are only asking you for the data they already hold. That's perfectly normal.  Otherwise anyone could email and impersonate you.  They need to be sure you are the data subject.

If unsure, send it and a summary of your data your concerns to their DPO email address instead.
