Cabot Debt Repayment

Hi all
I have been making repayments to Cabot for about two years and they sent me a letter to do a payment review so I went online into my Cabot account and upped the payment from £25 to £50 a month last week. The payment plan was updated and the new amount will start on Oct 25th.

However today I got an email saying my account will be put on hold for 7 days until I fill in a budget planner. Do I have to do this? I thought my new payment offer was all set up already and I am not refusing to pay and have never missed a payment.

Also I have recently learned this in an 'Unenforceable debt' can anyone explain what this means?

    Unenforceable means they dont have the original paperwork for the debt so they can't take any legal action to make you pay it. If you stop paying them then there is nothing they can do. 

    How did you learn thst it's s unenforceable? Usually you would make cca request and it would be unenforceable if they didn't provide the cca.

    It's a credit card from 2018, and the outstanding balance is £1000

    At the end of the email in the very small print it says
     'Your debt is currently considered unenforceable, but as your balance is still outstanding, we do still need to talk to you about your account.'

  • OK Stop paying and make a CCA request, it appears they know they can't provide a CCA so that will be the end of it.

    There is nothing stopping them asking you for money, but if I suddenly asked you for £1000 would you give it me?

    Ok thank you very much for the advice, So does this mean they definitely can't take me to court for this in the meantime?. 
  • Yes it does mean they can't do anything, they just ask in the hope you will pay.

    What is means is that you need to save that email carefully, send it to another email address, print a copy off.

    If they threaten legal action, defend it by sending them a copy of the email with the line highlighted.
