SPPA and McCloud

Do nhs Scotland workers know when we get our remedy letters? I thought we'd get them in October 2024 but the website seems to say only people about to retire will get them this October. The website also says members need to make a decision by March 2025, so expect we'll get them before then, just not necessarily this month. Does anyone know if they get posted to our home addresses or do we view them online?

    I don't think you need to make a remedy decision until you retire.
    If you are eligible for remedy you're not getting your 2024 Annual Benefit Statement until March 2025.
    "This will provide an estimate of your benefits in both the legacy (final salary) and reformed (CARE) schemes."

    Thanks for reply. They keep changing goalposts - I was told by email in October 2023 that I'd receive 'a dual statement each year until you retire, from August 2024 onwards'. I haven't received a statement since March 2022. If we're meant to make a decision by March 2025 but they only send the statements in March 2025, will members have enough time to make an informed decision, I wonder?

    The deadline for statements to be sent out is 31st March 2025, although there is probably a high risk that some more complex statements will be issued late - the legislation permits that for specific groups.

    Only "Immediate Choice" members - those who commenced pensions before 1 October 2023 and so retired prior to benefits being rolled back to legacy schemes - will be required to make a choice. These members have 12 months to make a choice from the date they are sent a Remedial Service Statement.

    Active and deferred members make their choice when they commence their pension. Members who have commenced pension since 1 October 2023 should have been given the choice as part of their commencement of benefits.

    * I am not familiar with SPPA NHS pension in detail, so it is possible they are working to slightly different dates to those listed above, but the principles will be the same
  • If you are affected by the age discrimination remedy (McCloud), your ABS will be combined with a new remediable service statement (RSS). 

    Remediable service statement has a deadline of 31/03/2025.  Annual Benefit Statements has a deadline of 31/08/2024.  Contact your pension provider and chase this up with them.  If all else fails, write to the Pension Regulator.

    Not what SPPA are saying.
    Note that there are slight differences between the SPPA schemes positions on this.
    For NHS SPPA you're only getting (gotten) an ABS in Aug 2024 if you're not eligible for remedy.
    You'll get a combined ABS-RSS by March 2025 if you are.
    The statement NHS SPPA have put out is as follows
    "If you are working and contributing to your pension or have deferred your benefits your Annual Benefit Statement combined with a Remediable Service Statement (ABS-RSS) will be available online by March 2025. This will provide an estimate of your benefits in both the legacy (final salary) and reformed (CARE) schemes."

    Doesn't look like there's much going to come from chasing prior to April next year.

    The SPPA should make it more clear. Their website says those affected by the remedy get their statement March 2025 but when they wrote to me by email in Oct 2023 they talked about a dual statement, which made me think that those affected by the remedy would get statements also in August 2024 - why else would there be the need for a dual statement?
    Going back to March 2023, they said statements would be deferred to Oct 2023, then 'August 2024' and now March 2025. They'll probably change the date again.
    I am affected by the remedy. Good thing I took a screenshot of the online SPPA portal message section where it said so as the message has disappeared. They did not sent a copy to my email address.
  • The same commitment was given for Civil Service pensions (dual forecast on ABS for 23/24) but all they have done is 'rolled back' everyone into the legacy scheme with a vague commitment that the online portal will be update to reflect the dual position at some point in the future. The only real fixed date is 31 March 2025 is to give options for those partial or fully retired
  • Lots of timescales for actions by the Civil Service were affected by an unexpectedly early General Election. The guidance is now trickling out from Government, quite a lot was released in September - I don’t know whether Scottish schemes are included in this.

  • If they can’t provide your statement now, what makes you think they can provide it in March? With the amount in errors and delays reported in other remedy schemes, I won’t be surprised that you won’t be able to keep to their March 2025 date and what will happen then? If you are undecided whether to leave now or later, this makes the situation worst off for you. Is this fair to people who are looking to leave or want to see whether leaving is a good option? I heard many people were told not to leave and others that did had to pay penalties. Is this fair to you and whether you know you have to pay back contributions with added interest? Were you told anything at all in between and whether any IFA costs could be refunded? Did you have any drop in sessions or perhaps been informed whether you can add more pension years? 

    Sitting on your backside now won’t do anything. Only action will to address these issues.
