Handling of pending county court judgement

Hi everybody,

My partner paked our car in a car park for Lidl and seems I overstayed by 17 mins. Initially I thought the allowed time is 120 mins but it was 90mins.

Anyway UK Parking Patrol Office company seems to be managing this parking and they sent me a fine of £100 which I found excessive and tried to convince them and Lidl to write it off but to no avail so I just ignored them.

Then they proceeded with their usual process of sending letters from credit agency and increasing the amount then letters from their legal representative bwlegal. I tried to get in touch with bwlegal to tell them that I wasn't the driver and did not tell them any details about the driver. But they rejected saying that because I didn't respond in 28 days that they the right to pursue me

Later, I received a letter from the county court about the legal case that they raised against me and I searched the forum here for how to handle this case and found some useful articles and followed the instructions to write a defence and send it by email

I got confirmation that the defence was received and it has been some time since then

Today I received a letter by post from the legal representative stating "We are writing to you because the court has struck out your defence to the claim"
I have not yet received any recent correspondence from the court regarding this and I was not clear on what they mean that the court has struck out my defence.

So I'm seeking help here if somebody who is experienced in this to explain what does their claim mean if it were true and what do they recommend to do as next steps.

    To clarify my partner was the driver at the time but I'm the registered keeper and owner of the car

    Login to MCOL and copy and paste your claim history below 

    Lidl don't normally use ukppo, its typically Parking Eye, so perhaps its nothing to do with Lidl, especially if there were several businesses on site 

    I wouldn't expect that ukppo complied with POFA, if they didn't then as keeper they probably haven't transferred liability from driver to Keeper

    I was waiting for any updates through post and did not remember to check online until now
    I'm not sure what DQ represents and if it is some step that I missed to act on

    Yes the parking is shared among a few shops and Lidl is one of them

    You received two letters from the CNBC: in June then in July directing you to complete the n180 form. You appear to have ignored it?

    No I did not move house but I was abroad
    What are my options? Does it mean I cannot progress with the case and it is finalised?

    Check again now and pray they haven't gone for a default judgment. Probably have since you left it three days to reply above.

    If not, fill in this form: https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track
    and email to CCBCAQ@Justice.gov.uk tonight, with a message explaining you were abroad and provide some sort of evidence.
    Then ring Northampton first thing in the morning and explain the same.

    To set the order aside you will have to complete an application (pay a hefty fee) and attach evidence of being abroad during the whole of the Summer.

    This was avoidable. You had a live claim in progress and just needed to check MCOL each week and/or ask someone at home to tell you about any post.  Either would have worked. You could have emailed a DQ from abroad. 
    Sadly, it's a very expensive mistake.

    An application costs £119 if you tick 'without a hearing' and attach clear evidence and a signed WS (and cross your fingers a Judge will give it the nod).

    The only other alternative is to pay in full this month and chalk it up to experience.
