Reliance byte unpaid fuel notice

Hello All
Has anyone had any run ins with a company called reliance byte? I received a letter a few weeks ago saying I was being charged for unpaid fuel as I’m either the registered keeper or driver at the time, they inside cctv images. I am the registered keeper but was not the driver and the driver is clearly shown in the images as a male. So I rang them and emailed them, no response. When ringing I get useless individuals saying nobody can answer your call and I try and explain nobody comes back to me and all I get is, oh well.
Anyways the new letter states that if I don’t pay within 14 days a ccj will be registered. Do reliance byte have this power? Or does it go through the usual small claims track? As previously asked, has anyone managed to ever get through to these people? Thanks for the help.

Have you actually received a letter from the court?
You are wasting your time phoning and E Mailing.
You have to have a letter by snail mail.If you go down to the woods today you better not go alone.0 -
Do you recognise the driver ?They cannot "issue a CCJ", only a court can do that. It is pretty much a tactic to get you to pay, if they do go to court your defence would be it is obviously not you in the pictures. If you do know who it is, and I get the feeling you do, why are you not willing to tell them ? They could possibly report it to the police which could result in your car being randomly stopped.0

You have to have a letter by snail mail.No I haven’t, it just says on the letter that if payment isn’t received within 14 days this will result in the registration of the debt at the county court. Haven’t even received a letter before claim.0 -

You cannot just register a CCJ, only the court can do that, and only after a successful claim, they must use the same small claims track available to anyone, so if they go down that road, you should defend the claim on the basis that you were not the driver at the time of the incident.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. So I have now received an email response after sending my signed letter. They state they will not change the notice to the driver as apparently they will only do this if I can provide a signed hire agreement between me and the driver. Absolute rubbish. As far as I’m aware the driver and person dispensing fuel is the one who forms the contract to pay the fuel. Is that right? Surely the registered keeper is only on paper and the actual owner or a car or the person insured to drive a car can all be different people so the registered keeper, as long as they can identify the driver, has to pay this?0

Stop trying to deal with those who won`t apply common sense, defend the claim, when/if it comes, as you were not the driver, get your evidence together, and let the court decide who is right.
As an example, when you get caught by a speed camera, you get a NIP in the post asking if you were the driver at the time of the incident, so the driver has to be named in order to prosecute, similar guidelines apply here.
They are being deliberately belligerent as there job is to extract the fine from you, using any and all means at their disposal, so they will say and do anything in order to make that happen, the last thing they want is this to end up in front of a judge and make themselves look stupid.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. As sourcates says, let them take you to court, they are barking up the wrong tree, its scare tactics to get money. At least 4 people are covered or insured by me to drive my car, its up to them to find out the driver. I would love to listen to this one in a magistrates court.Baby Step 6/7 - £65000 saved for emergency fund DEBT FREE !!!

Let them report the theft of fuel to the Police.
If it's reported to them and you're the registered keeper they will ask you who was driving at the time of the incident and deal with it accordingly.0
