Hello , I’m posting to see if anyone can give me some advice/ guidance on my current employment situation. I have been employed by a big company who provides security services I was based in working for a bank as a security guard I had been in that position for 10 years. Now the contract was up for tender and the company in worked for had lost the contract after supplying there services for 10 years. Myself and 4 others had been offered and accepted to TUPE over to the new company who won the contract 2 weeks before the TUPE transfer I was contacted by my boss via telephone to be told I am being suspended from the bank site for a breach of trust I would be suspended on full pay and will be contacted when they do an investigation and might have to be placed into a different site depending the outcome. While on suspension the TUPE transfer has taken place I’ve been suspended for 2 months with no explanation no contact has been made by my employer. I’ve tried to contact him on for his phone to go to voicemail, I’ve contacted head office via telephone and got talking to an operator she told me my boss had left the company and took my details to pass on. Still no response or contact from the company has happened and my lasted suspension pay is wrong. I’m stuck on how to approach this as I’ve tried multiple times to contact the company just to be fobbed off with I’ll take your details and pass them on. Any advice or guidance will be greatly appreciate, Sorry for the long speal it’s quite a complex situation.

It is quite unusual for such an event to occur coinciding with the TUPE transfer - do you know whether any of the other 4 that accepted the TUPE transfer were also suspended?0 -
I’ve had no other information given to me other than a breach of trust I was told I would hear back from my boss in due time when they do their investigation that was on the 16th of August. All other employees have transferred over and are now working for the new company except for me. I actually contacted the new company to see if they could give me any answers as my company has not. They told me they had received a email from my employer stating that I would not be involved in the TUPE transfer due to being on suspension.0

Redundancy is when a job ceases to exist, which doesn't seem the be the case here. The OP was suspended by his previous employer, so without knowing full details of the likely outcome of that investigation it's impossible to say whether their employment would have been terminated.

OP, are you being paid whilst on suspension as the advised?
If so, then it sounds like you have not Tupe'd across to the new company.
Have they set out why you were suspended in the first place?
Are you in a Union, if so it may be one of the times where they have some use.
Otherwise I would speak to ACAS (https://www.acas.org.uk/) and see what they advise. At the very least I would be writing to the HR department of the company requesting an update on status and timeline, preferably via a call.

Hi everyone thank you for your comments, As of today I’ve not been paid at all , I’ve sent emails to HR , I’ve sent emails to pay roll , I’ve tried so many times to contact my Company and still no response from them at all. I still haven’t been told anything about a investigation on my suspension all I’ve got to go by is a telephone conversation by my then line manager on the 16th of August that I’m suspended on pay due to a breach of trust. The line manager has left the company and I’ve a feeling he has not acted on my case before he left the company so I’ve been forgotten about maybe 🤔. But the thing is on my last 2 pay slips that were paid they state suspension pay that tells me surely someone has to know what’s going on ? I’ve been in contact with Labour Relations Agency and they are going to try and contact the employer for early consolation if not possibly will go to tribunal.0
