Look in your contract or your company's policies. Most large companies will have something documented to a) protect their business and b) ensure their employees are in a fit state to do the work they're paying them for.

What sort of work? Any potential conflict with the work you do for your company?

Pedant alert - it's could have, not could of.

if you, for instance, do insurance work or are a bank employee and are doing gardening for you work mates I don't think there will be any issues.  If you are an accountant working for a large accounting firm and are doing tax/accounting work for your colleagues I would think there's an issue.  But the contract T&Cs will clarify either way.

The sensible thing to do is speak with your employer and ask them if it's OK by them.
If you're concerned that they may say it's not, then it probably isn't and could get you into trouble at work. I know a couple of people who got sacked for doing work' on the side' that should have gone to their employer

Who you're doing the side hustle for is not relevant.

If your contract says you may not do any other work, things are clear.

If it says you must tell them about / get their permission for any other work, things are clear.

  • The payments would likely be taxable over £1k. Will you declare them?

Depends on your trade and the nature of the work you are doing for them.

If you are a Train Driver doing gardening then shoulder be too much of an issue

If it’s just a weekend labouring then again ok

If its a regular arrangement - as mentioned, you need to check. Some employers may object on the grounds that in the scenario of a dispute, it may (will?) affect workplace relationships and thus affect the business
  • Most employment contracts have clauses in about additional employment. You should check on this and declare it if needed. Also if the work you are doing on the side is something which could carry the risk of injuries or strains that prevent from working for a time, you will be in very dicey position trying to get sick pay for an injury sustained in a side hustle that you didn't inform your employer about.
