HALLOWEEN ‘BECOME A REESE’S TREAT’ COMPETITION – MARKET WIDE TERMS AND CONDITIONS

Welcome to the Reese’s Halloween Competition UK (the "Promotion”).

These Terms & Conditions (the “Terms”) are intended to outline the rules by which the Promotion will be conducted.

1.Conditions of Participation

1.1 In the event of any conflict or inconsistency with any other communications, including advertising or promotional materials, these Terms will prevail. The Instructions for Participation are deemed to form part of the Terms and by entering, all participants will be deemed to have accepted and be bound by the Terms. Please keep a copy for future reference.

2.Promoter and Administrator

2.1 The Promotion is organized by The Hershey Company - 19 East Chocolate Avenue, Hershey, Pennsylvania 17033 (the “Promoter”). The administrator of the Promotion is the partner agency Savi Marketing GmbH, Christoph-Probst-Weg 3, 20251 Hamburg, Germany (the “Administrator”). Submissions to either address will NOT be accepted.

3.Eligibility to Participate

3.1 To be eligible to participate in the Promotion, individuals must: (i) agree with the Terms and the Privacy Policy; (ii) be at least 18 years old at the time of participation; and (iii) be resident in the United Kingdom; England, Wales, Scotland and Northern Ireland (the “Participants”). Proof of age and residence may be required.

4.Exclusion

4.1 Employees (and their immediate family members) of the Promoter, the Administrator, and all other persons who are professionally involved in the Promotion are excluded from participation.

5.Entry Requirements

To participate in this Promotion, Participants must: (i) scan QR code on point of sale in store at selected retailers or have access to the internet so that the participant can enter via microsite link (www.reeses-win.co.uk) (ii) agree to these Terms and have accepted the Privacy Notice and confirm they have satisfied the eligibility requirements in Section 3.

When you enter the Promotion, you will automatically be entered into the Grand Prize draw if you meet the requirements of competition entry.

5.1 The competition will be available to enter via the microsite link referenced above but also in selected retailers:

(1) Sainsburys (main estate), Morrisons (main estate) and Morrisons Daily

5.2 Participants will also be required to provide the following mandatory personal details: (i) first name and surname; (ii) email address (together, the “Mandatory Personal Details”) to enable the Promoter to contact the Participants if selected as winners. Failure to do so entitles the Promoter, in their sole discretion, to determine that the Participant forfeits their right to win any of the prizes outlined in these Terms. 5.3 Entries received outside the Promotional Period shall not be valid for entry into this Promotion.

5.4 No third party or bulk entries. Entries via third parties, consumer groups or syndicates, will be disqualified.

6.Promotion Period

6.1 The promotion begins on 19th August 2024 at 00:01 BST and the closing date for entries is 7th November 2024 at 23:59 GMT (the “Promotion Period”). Entries received before or after the Promotion Period will not be considered. The winner will be contacted on or before 8th November 23:59 GMT.

7. How to Enter

7.1 Participants must:

(i) Scan QR at point of sale material in store at selected retailers to be taken to microsite in order to enter competition

(ii) Or visit www.reeses-win.co.uk directly and enter the Mandatory Personal Details

8. Entry in the Promotion

8.1 All valid Participants who enter in the Promotion Period will be included in the database from which the electronic system will randomly draw a winner for: (i) the Grand Cash Prize and chocolate sculpture prize

9.Participation details and Participation Restrictions

9.1 Enter through scanning QR code or directly through microsite URL

9.2 One entry per person/ per email

9.3 Duplicate entries will not be accepted. If it is determined that a Participant is attempting to circumvent these Terms in any way (including but not limited to multiple cell phone numbers, email addresses, IP addresses, identities, computer fraud using "scripts", "brute force" or other automated means) to cheat or abuse the Promotion, such Participant will be disqualified and excluded from participation and all prizes awarded will be void. Participations, done by third parties or using automated equipment or processes are not permitted. All entries will be closely monitored by online systems and any entry found to be in breach of these Terms (or any part thereof) will be disqualified. Any Winner of a prize who has been disqualified may be required to return the prize awarded or compensation of the same within 14 days of the return request.

9.4 Incomplete entries or entries that do not comply with the Terms will not be accepted. Participants who fail to provide correct information or who register on behalf of someone else will be disqualified. No entries will be accepted from agents, third parties, organized groups or entries automatically generated by a computer. No bulk registrations.

9.5 The Promoter reserves the right to review all entries, including but not limited to requesting proof of identity of Participants to be sent via email (which must be provided within 7 days) and to refuse to award any prize or to withdraw entitlement to the Prize and/or refuse further participation in the Promotion and disqualify the Participant if there is reasonable grounds to believe that there has been a breach of these Terms or any instructions forming part of the Terms of this Promotion, or if a Participant has obtained an unfair advantage or fraudulent gain by participating in the Promotion. The Promoter will be the final arbiter in all decisions, and these will be binding and no correspondence will be entered into in relation to this clause.

9.6 Option when entering the competition to opt in/ out for the winner to share photos/ videos of their finished sculpture once it’s sent and delivered to the winners address.

10. Halloween ‘Become a Reese’s Treat’

10.1 Grand Cash Prize of £5,000 AND x1 Chocolate Sculpture (the “Grand Cash Prize”). One (1) Grand Prize is available to be won in the Promotion Period.

11. Selection and Notification

11.1 All Participants with valid entries in the Promotion will receive an email within 5 to 7 business days of entry, which will confirm approval of having been entered into the draw to win a Prize.

11.2 If Participants have entered details that are in any way incorrect, invalid, or insufficient, the Participant will receive an email confirming that their entry into the competition has been declined.

11.3 Winners will be drawn at random by an independent electronic system, and the x1 Participant who is the winner (of both the cash prize and the chocolate sculpture prize) will be contacted [via email] on or before 8th November 2024 23:59 GMT.

11.4 The cash prize of £5,000 will be paid via bank transfer, to a UK bank account in the winners name. They will be contacted to provide their bank details within 7 days after being notified they’ve won (8th November) and the payment will be made within 28 days of acceptance.

11.5 Participants must respond [via email] no later than 14 days after email sent (which will be sent on 8th November) notifying they’re the winner and requesting the following information: correct bank details belonging to the Participant for the cash prize and following details below will need to be provided for arranging the chocolate sculpture to be made:

11.5.1 Winner will be asked to supply a minimum of 5 photos from multiple angles (360°) of their head/shoulders for the bust to be created. A photo guide will be supplied to the winner for particular photo requirements.

11.5.2 Bust will contain approximately life-sized head and shoulders; please note that 100% likeness cannot be guaranteed and this will be a creative interpretation of the winner by the Chocolatier.

11.5.3 Winner’s photos must be received by the Chocolatier by 30th November 2024.

11.5.4 Sculpture will be made and dispatched within 12 weeks of receiving photos. Please note this will not arrive before Christmas.

11.6 Info on the chocolate sculpture: the chocolate sculpture will be a milk chocolate* bust, with a Reese’s peanut butter filling, representing the winner.

* Milk chocolate ingredients: sugar, cocoa butter, whole milk powder, cocoa mass emulsifier, soy lecithin (E322), flavouring (natural vanilla). + Reese’s peanut butter filling.

11.7 In the event that the Participant:

(i) fails to comply with these Terms; .

(ii) has provided an invalid email address;

(iii) fails to provide correct or complete bank details when requested;

(iv) ignores the email(s) sent requesting information within the prescribed period;

(v) does not provide documents to provide their identity or sign any documents or statements as required;

(vi) does not provide the validating receipt when requested;

(vii) is unable to accept the Prize as set out for any reason; or

(viii) in any way does not meet the requirements to be eligible to win the Prize;

the Promoter reserves the right to cancel the given Prize or offer the Prize to an alternative winner, selected under the same conditions.

11.8 The cash prize will be paid to the Participants who has won a Prize (the “Winner”) within 28 days of receiving full and complete Participant information as outlined above (section 11.4).

11.9 When receiving the Prize, the Winner or person authorized by the Winner to do so with a special authorization, must sign a declaration of acceptance of the Prize, which terminates all further obligations of the Promoter and Administrator of the prize game towards the winner.

11.10 Personal data is required for Participants to redeem their prize. The personal data that may be collected from the Winners for validation purposes include, but are not limited to, (i) the Mandatory Personal Details; and (ii) bank account details, including [account name, account number and sort code].

11.11 The Winner acknowledges the right to the Prize only after validation of identification, receipt, identity and any other required validations, otherwise the Participant may lose the right to the Prize.

12. General

12.1 The Promoter will make every effort to ensure that the website functions properly throughout the Promotion Period. However, the Promoter accepts no responsibility for any defect or disruption in the operation of the website that affects the performance of the Promotion.

12.2 The Prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. If, for any reason, Winners fail to claim any portion of the Prize by the time determined by the Promoter and outlined in these Terms, that portion of the prize will be forfeited, and no cash or other form of compensation will be awarded in lieu of that portion of the Prize. Should a Prize be unavailable for any reason, the Promoter reserves the right, at its sole discretion, to substitute another prize of equal or greater value if circumstances beyond the Promoter's control make this necessary.

12.3 While we want you to enjoy this promotion, we discourage over-consumption. Please do not purchase more products than you can reasonably use to increase your chances of winning.

12.4 The Promoter shall not be liable for any loss or damage of any kind incurred as a result of participation in the Promotion or the redemption or use of the Prize. The Promoter, and their respective direct and indirect subsidiaries, affiliates, owners, shareholders, officers, directors, agents, representatives, and employees shall have no liability or responsibility whatsoever for any claim arising out of or related to participation in this Promotion or any prize awarded. Winner irrevocably waive all such claims in this regard. The Winner agrees to indemnify and hold harmless the Promoter from and against any injury, loss, damage, claim, suit, or liability of any kind and irrevocably waive all such claims in this regard. Promoter will not accept any liability whatsoever resulting from the participation of the Winner in the Promotion. The liability of the Promoter or his employees, agents or subcontractors for (a) gross negligence and intent, (b) the violation of contractual cardinal obligations (i.e. obligations that are essential for the achievement of the purpose of the contract), are not restricted or excluded by this.

12.5 The Promoter accepts no responsibility, does not recommend, or guarantee the performance of any contractual or other obligations of any third party in connection with the Prizes and shall not be liable for fraud by any third party.

12.6 The Promoter reserves the right to disqualify any Participant if it has reasonable grounds to believe that the participant has breached these Terms. The participation instructions on the internet and in all other marketing materials form part of these Terms.

12.7 If for any reason any aspect of this Promotion cannot be carried out as planned, e.g. due to computer virus infection, network failure, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the Promoter's control that affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, at its sole discretion, amend or suspend the Promotion or void any affected entry.

12.8 The Administrator collects personal information from the Participant for the purpose of administering this Promotion. This includes contacting the Winner by email and posting information about the Winners by post and on the website. By participating in this Promotion, Participants consent to the Privacy Policy [available at https://saviuk.co.uk/privacy-policy] and the collection and use of their information in this manner. The data will not be used for any other purpose unless you agree to receive communications from the organizer in the future. Your personal data will be kept by the organizer for up to 12 weeks after the end of the campaign and then securely destroyed.

12.9 The Promoter reserves the right to amend these Terms at any time. If any provision or part of a provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed to be amended to the extent necessary for its validity, legality and enforceability. If such a change is not possible, the relevant provision or partial provision is deemed to be deleted. Any modification or deletion of any provision or part of a provision pursuant to this clause shall not affect the validity and enforceability of the remaining provisions of these Terms.

12.10 Any dispute that may arise in relation to the interpretation, application or non-compliance with these Terms or the provisions hereof or arising from the Promotion shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England.
