Lowell Do I still need to keep paying them for old debt

Got a default some years ago via Barclaycard this was around 2018. The default no longer exists on my credit file as it expired after 6 years. However, the debt was sold to Lowell who I have been paying via D/D at £30 per month.  My question is do I still have to pay them the outstanding debt considering the original debt is now abut 7 years old. Thank you

    It only becomes statute barred after six years of no payment or contact from you, whether you continue to pay or not is your choice but the fact its no longer on your credit report makes no difference to the legal situation.

  • Ok thank you. If I decided not to pay any more payments could Lowell enforce further legal action which may affect my credit status?

    There are maybe two parts to your question.

    Is the debt 'too old'? No, it may be off your credit report but you are still legally liable so it's not too old.

    Do I need to keep paying this? No, it's a nonpriority debt and you could stop.

    If you are minded to do this, I would definitely do a cca request first to see if Lowell can comply. Until they produce it, and it is possible that they never will, then the debt is unenforceable under s77-9 CCA 1974 and so if they ever started a court claim you would have a defence.

    You must do the request properly and enclose £1 postal order
