Hello all,
I am in my final year of a bunch of defaults. I had a Lloyds credit card that was sold to PRA and the default fell off in July. The debt was unenforceable for many years as they couldn’t send me the CCA but recently they have provided one and have sent me a county court claim form. Not sure how to proceed. The debt is around £2k and I’ve recently been made redundant. Should I offer a reduced settlement or a monthly payment? Any advice would be appreciated, thanks

Once there is 6 years from your last payment ( assuming you live in England or Wales) then the debt is statute barred. My guess is it is approaching 6 years and PRA are trying to get a Court Order before it is too late.If you go down to the woods today you better not go alone.1

You should acknowledge service online, it gives you 28 days to defend the claim.
If you are not working, then make sure all the forms are filled in correctly, a court may not allow you to pay anything if no regular income.
Of course depending on your answer to my question, as the default dropped off in July, cause of action date is 6 years from date of default, not last payment, so depending on what was said, it could now be statute barred.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Go with the court process then, make certain you say you were recently made redundant.
