DMP to CCJ Charging Order Help Appreciated

    A court claim should not be started when a debt is disputed. I dont know whether an affordability claim counts as a dispute but I hope it would. 
    You are in a difficult situation here as the debt is massive so its worth the lender looking closely at this, which wouldn't apply to most debts, and the lender (is it your bank?) has worked out you aren't being truthful about what you can afford to pay. Thats why going through Step Change can help as they are independent and will include all your debts and also the bank will be getting much more (I assume) that what you have optimistically tried to get away with. 
  • Thanks ManyWays, the debt with this bank is 28k, but that's the same bank as my current account. I think I have good grounds for affordability having looked at what is on Debtcamel.

    If I go Stepchange, do all my debts need to wrap into that? Guessing they likely do?

    Step Change may not check very thoroughly but you want them all in there, why would you leave any out as your spare income over reasonable expenses is going to the DMP so you wont have money to pay other debts. 

    HSBC can see from your bank statements that you have more money than you have offered them. Moving to a different bank is also a good idea.

    Sorry to jump on your old post. I am also planning on creating my own post too after gathering some info. 
    Why would a lender jump straight to legal action instead of accepting a payment plan? How common is this?
