Double council tax fees

Following the death of my dad and going through probate which took 6 months , 2 sales on my dads flat have fallen through and as the house has now been empty for over a year I am charged double council tax . Initially I was allowed a concession to deduct from the estate but as my said has fallen through ( so stressful )  they are now me to pay these fees . I can’t possibly pay council tax on 2 houses !! What can I do ? I have never been in debt my whole life ? I am waiting for a call back this morning from a payments manager at the council but I feel really stressed and worried about this . All seems very unfair

    they will try to make you pay but actually if the property is still owned by the estate (you haven't changed the ownership have you?) then only the estate is liable. is / was there any other money in the estate to pay the bill ?

    You won't be in debt it will be the estate

    "

    Council Tax Liability for Executors

    Executors are the people appointed in the will to deal with the estate of a person who has died.

    When probate is granted a document is issued to the executor providing them with the authority to deal with the estate.

    If, after probate is granted, the ownership of a property is transferred to a beneficiary of the will, any liability for Council Tax passes to the beneficiary.

    If for any reason after probate has been granted the property remains under the control of the estate for more than six months, a full Council Tax charge is due. The executor is responsible for making payment of the Council Tax.

    The executor is not personally liable for Council Tax charges, and payment should be made from the deceased estate.

    If the executor cannot make payment for any reason they should contact the council immediately."

  • If there is no cash or other liquid assets in the estate then you should explain this and they like any other creditors of the estate will need to wait for the payment of any CT due.

    Why did the sales fall through? Is there something you can do to ensure it doesn't happen a third time?
