Hi all, started debt free journey around 6 months ago and have just started getting defaults. Barclaycard has been sold to PRA who have just written to me this week. The account is around 13 years old. Is now the time to request the CCA or should I wait longer? TIA for advice.

  • Also just to add, I wrote to Barclaycard twice on the irresponsible lending route. I had a credit card with a £13,500 limit on 24k and they kept increasing the limit. My last correspondence to them was around two weeks ago as I had not heard from them regarding complaint. So I don't know whether I can go down CCA route yet or if the companies converse with each other enough to know that I also have a complaint with Barclaycard (well not anymore as account is now closed!)

    You can always make a formal cca request, provided you don't do more than 1 per month.

    Remember the £1 payment.

    Yes, do both. Cca to PRA, and if eight weeks have passed since your complaint to Barclaycard, escalate it to FOS
  • Thanks so much for advice. So, the £1 payment, I don't have a cheque book, so what is the best way to pay that? I remember reading you have to state that it is only to be used for request and not towards balance?

    You can use a postal order instead. PRA sent my £1 cheque back saying they don't charge, presumably it's not worth them bothering with such a small amount. If you leave the postal order blank you can use it for the next request.

    They really need to update the law given thst nobidy uses cheques any more.

    Yes I think it probably dates back to the original act in 1974.

    There are changes coming which will no doubt be to the detriment of the consumer!

    This from .Gov website:

    "On 10 July, the government published a response to its consultation Reform of the Consumer Credit Act (CCA). The document provides an overview of the feedback to the consultation and outlines the government’s proposed next steps. Overall, stakeholders were supportive of reforming the CCA and the government plans to move forward with an ambitious overhaul of the CCA. As a next step, the government will be undertaking policy development to produce more detailed proposals, with a view to publishing a second stage consultation in 2024 to seek comment from stakeholders".

    Just my thoughts, but I can see sec 77 being repealed or changed to better serve the creditor, we`ll see eh.

    You still have a complaint with Barclaycard about irresponsible lending, they cant escape that by selling the debt. If it has been 8 weeks since your first complaint, you can now send this to the Ombudsman.  
  • Thanks everyone for all the advice. Got my £1 postal order today, blank as advised and will be sending it to PRA tomorrow along with complaint to FOS about Barclaycard. 

    Interesting information regarding the CCA changes, a bit nervous to see the outcome of the second consultation.
