PRA group woes

Options
Long story short.
PRA applied to county court for a debt just over 3k despite me contacting them for the cca on 1st July.
I acknowledged and disputed claim as had asked for the cca.
Received a letter from PRA saying they would supply the cca paperwork and intended to still go to court.
No cca has been provided.
And today I received a notice of proposed allocation to the small claims court and more paperwork to complete.
Why would they do this?
Obviously I'm not giving in now and intend to defend .
Any tips please you lovely lot.

Do you think you know who the CCA was with originally?   It's possible that if the debt was sold on it will take a while to provide - I've heard people talk about 3+ months.  Or is PRA acting on someone else's behalf (i.e. debt not sold)

I would suggest you go ahead and fill out as much as you can with the paperwork.  And have copies of your requests for the CCA and any other relevant correspondence.  I agree it's silly of them to push on when there may be no case to answer but that's possibly why they're doing it - trying to scare you into submission.

  • That's what I think.
    It's Barclays credit card.
How long should it take to get a cca?

How long is a piece of string?  And was the card always a Barclaycard?  Mine was originally a Frizzell card, then GoldFish, then MorganStanley and finally a Barclaycard.  If yours is like that the CCA likely no longer exists in any format.

But my point is that if you provide evidence of asking them for something which they have failed to provide that won't impress whomever is presiding on the case.

You should defend the claim on the basis you are still waiting for paperwork.

The case will likely be stayed until that arrives, if it does.

If they comply and all is in order, the case will continue, if they don`t, it will most likely be struck out.
