Unilateral Notice of Interim charging order from 15 years ago, nothing paid or agreed since then.
I concentrated on my other debts longing for the more quiet phase that usually follows after they secure the debt. The debt has been sold on and the registered beneficiary on the notice has not been updated and no longer owns the debt. I spoke to the company with the debt now to get a statement and they seemed to have incomplete or incorrect details but correct CCJ number. Is it possible for a UN of an Interim Charging order to lapse? No final charging order was registered against this title. No interim charging order, only the UN of one. I would like to get a bridging loan and sell the property. So I need to get rid of this notice ASAP. Other presumably correctly applied charges on this title for different lenders say Equitable charge created by an interim charging order, then 6 weeks later another entry for the same charge: "Equitable charge created by a final charging order". These lenders did the (registry part at least) properly and then stopped bugging me. Hopefully they will get their money soon. This entry is simply "Unilateral Notice in respect of an interim charging order dated xxx 2009 in the ....." The broker helping me seem to think it needs to be paid off.

1. Yes it will need to be paid off for the order to be removed OR you will be unable to sell.
2. Why do you need a bridging loan? - they are expensive to set up and difficult to get these days - high street banks no longer offer them. The charging offer will stop anybody lending to you against the property - first thing a potential lender will do is check Land registry.0 -

I plucked up courage and spoke to the owned of the debt on the phone a second time. The debt owner confirmed that they have no charge on the property for the CCJ (the number mentioned in the UN).
Initially they wanted it paid off in full and sent me by email at my request, an account summary, with the CCJ reference, the balance and a summary which contained the phrase "failed charge". It seems nowadays these agencies have to be more honest than in the past on the phone and in paperwork if you ask the right questions. They confirmed no payments, and that they would need to go back to court before chasing me up again as it is more than 6 years ago since and no movement on the account. I asked if they had a signed CCA on file and they said no, but they might be able to get one from the original lender. They then offered me 25% off the balance, and said that was the most they could offer.
What was interesting here is that a Universal Notice of an Interim charging order, whereas the other charges entries said Interim Charging order, then Final charging order. The owners of one other properly applied debt offered a most welcome 10% off. I read that sometimes the lender secures the interim charging order, then the final, but does not always update the land registry with the final charging order details. I tried to check with the court but the phone has been busy all day. It is over 6 years old so from my understanding the online register won't confirm anything. There are errors in their paperwork I didn't pluck up courage to talk about the UN removal, they might not remember they put a notice on.
I have asked them to update their email with the 25% reduction for me to consider. I offered them 6.2% of the amount they claim. I read of others settling unsecured debts for 5%. 6.2% is all I have at the moment.
I need the bridging to unwind and simplify my situation and ultimately sell. It is 1% plus fees deal. Could be worse.
About the UN4, there is a documents attached section, I would like to put something to say that the CCJ mentioned would need to go back to court for enforcement. The CCJ is not on any registers I have access to. Has anyone any ideas about. There doesn't seem to be a reason for removal section on the form.0 -
