PRA group and Barclaycard

Hi.
I have been reading lots of your great advice on this forum. I have taken aboard and having cancelled debts in Dec 2023, most of my debts are starting to get defaults. I was going to go through Stepchange and go with a DAS. However I have decided to go self managed DMP as I feel I would like to try and pay of debts quicker than step change would allow.
My question relates to PRA group. They have contacted me saying barclaycard has sold them the debt. I owe £ 5500. I have read about asking for a copy of the credit agreement? Unsure what this is and if it applies to me or not? Original barclaycard account was opened in Oct 2015. I stopped paying it in Dec 2023. Is this something I should be looking into?

You are thinking of sec 77/79 Consumer credit act, or what we refer to as a CCA Request.
Its one of your statutory rights under the act, failure to comply can result in the debt becoming unenforceable.
It applies to any consumer credit agreement with a balance left to pay on it.

Hi. Just a little update, PRA group have come back to me saying they are currently deeming the debt unenforceable. They sent me some copies of bits from Barclaycard but in letter says it's unenforceable currently. I assume I can continue to ignore this debt. Debt is £5500.

Yes, for now at least, however they may come back to you with enforceable paperwork, so don`t celebrate just yet.

They may come back my card was taken out in 2012. If they do just log onto their website and setup a payment you can afford, not need talk to them.I have Dyslexia which is a learning difficulty that primarily affects the skills involved in accurate and fluent word reading and spelling so some post may not make sense.0

as above dont pay them anything and dont talk to them on the phone. Chances are they wont get the CCA. i was lucky enough to go over 6 years without them obtaining it and it turned statute barred. They did repeatedly during the last year try and phone me everyday ( i blocked their number so all they could do was leave an automated message). After 6 and a half years i phoned them and cthey confirmed it was statute barred and even put it in writing. So good luck.1
