Anyone else get done over every year by this? It's not the ruling itself, it's that they only apply it when it suits them.
So annual review should be the latest figure they have from HMRC. Every year they give me the wrong calculation as they don't include the P11D figure. Every year I tell them that they should and every year they tell me they can't as it's not more than 25%
It drives me utterly insane. I've been to tribunal over this and was ruled that CMS were calculating payments incorrectly and included a lot of backpay, so much so, my ex husband now volunteers his P11D information to me when they get it wrong (and we're not on the best of terms)
This morning it's happened again. I will send off my MR, which will be rejected, and again go to tribunal. I've involved my MP who was useless.
Why don't they have any common sense??
