Anyone had any success

Options
I am coming to the last cpl of yrs on a 22 yr term mortgage. The ex hasn`t paid anything since he left. So approx 18hlf yrs. He has been working and had a large financial payout. So has had the means. He also left 5k council tax debt, mortgage arrears, 300 landline bill and had a hp car taken off him before he went. I want him removing from the deeds and the mortgage. I`ve been told I could take him to court and have the house awarded to me. W as just wondering if anyone had any success in doing this. I just know the poo poo will hit the fan when he finds out.

You say ex. Do you mean divorced?

    yes, ex husband
  • Then shouldn't the property have been considered in the divorce settlement?  What was agreed then?

"Not being happy" doesn't overrule court orders.  I'm not an expert on divorce settlements, but the few I have seen don't say "the house is split 60/40 but you both need to keep paying the mortgage together for another 15 years".  What did it actually say about that?  Or if you don't want to tell us, ask your divorce solicitor.

And if he didn't pay child maintenance when ordered to, that should have been dealt with at the time.  It's not particularly relevant now.

You cant just get someone taken off.
It has to go through the courts. He is likely to argue that.

You need to speak to a solicitor.

i know i can`t just take him off. I`m trying to say he hasn`t paid ANYTHING for anything since he left. And the law states he should pay half.

Which law are you referring to? Remember your ex has had to pay for their own housing costs since he left. Two sides to the matter.

What did the court order state about the debt? It too should have been covered.
