State pension

Hi,
My husband passed away almost 5 weeks ago. He was 59 so hadn’t reached state pension age. A member of my family thinks that I can claim part of his state pension, I’m 57 so also below state pension age. I have searched on the direct gov site for information regarding this but can only find anything relevant if we had both reached state pension age before he died.
So I’m struggling to find anything about my situation, and as I’m obviously very upset from losing him don’t want to spend time pursuing something if theres no point.
Can anyone offer me advice about this please?

You may be able to claim a percentage of his Protected Payment if he had one. The Protected Payment is the amount above the full new state pension which is currently £221.20pw. You won’t be able to claim this until you reach SPA yourself.What you can claim now is Bereavement Support.3

Thank you for replying. I have claimed the bereavement payment which helped towards funeral costs. I have no idea if he had the protected payment? He was self employed until around 5 years ago, so paid his contributions annually. Then he was PAYE, so his employer would of paid his contributions, thats as much as I know.0

Your late husband would have had a "protected payment" if at 6/4/16, his "starting amount" for SP was higher than a Full New State
Pension ( £155.65 at that time).
The starting amount was the higher of
Old Rules
National Insurance Qualifying Years/30 (max) x £119.30 + ( Additional State Pension - (if applicable) Deduction for Contracting Out of
ASP)
New Rules
(NIQY/35 (max) x £155.65) - (if applicable) Contracted Out Pension Equivalent.
You do not mention that your late spouse ever obtained a State Pension Forecast (which would have shown his position regarding any
PP).
It may be that the Future Pension Centre could assist?

You mean this bit46.
Inheritance of the Protected Payment amount is conditional on the marriage or civil partnership having been existant prior to the introduction of single tier. In cases where a marriage is formed after the introduction of single tier, and where the Contributor has a Protected Payment, there will be no provisions for the Dependant to inherit the Protected Payment.
