New Build Property Management overdue Service Charge Legal Development Fees

Having moved into a new build residential property, when fees come through from our property management company (Gateway) we pay on time including any adjustments throughout the year.

Received a letter from Gateway stating an additional £41 is due to our unit and reading the fine print it states that it’s aligned to legal expenses due to the recovery of service charge payments.

Contacting them directly, I’ve been informed that unfortunately legal expenses are aligned to the development, essentially we have to pay legal costs and fees incurred for those living in the development who haven’t paid or paid late? 

Surely this is completely illegal and unfair?

    not if you signed a contract and agreed to it - which I presume you would have done.

    whether it's morally right is another question - but look at it like this - if the management company don't get the money from somewhere - they can't pursue costs - so what happens when nobody pays?
