Anyone else with Xbox 360 PRO problems?

After reading all the advice on this forum i got my son what i believed to be the newest and most reliable system for x-mas. It has all the correct labelling to be a 'good one'. Lower power, HDMI etc...
However, he has had a number of problems..
1/ a disc is scratched and unreadable. The disk ran for a couple of days and got scratched the first time the machine was lay horizontally. It has clearly been scratched in the machine because the scratches are circular/concentric.
2/ it occasionaly freezes/crashes and can only be fixed by switching off/on.
3/ sometimes the picture becomes distorted and the colours go wrong with random blocks of colour.
I've just googled 'xbox 360 problems' and there are web sites including wikipedia discussing the above issues and more. I knew about the red rings but didn't realise that it was full of other design errors.
I'm taking my sons box back to HMV on saturday and would like to know how other people have got on with such problems.
I dont want to wait for it to be repaired. Am i entitled to a new machine and disc?

hmv were useless with me,told me i had to contact microsoft direct. My sons still keeps freezing now and again now and unfortuantely he has just got used to it however i will send it away for repair once he is back at school in january, this takes about 2 weeks though0

I work at a gamestore and Xbox's are the most returned item due to freezing and ring of death problems. I know we have a 1 year guarantee with all consoles, if HMV do not have this I know microsoft have a guarantee on the Xbox's too.
I think we advise people to lay the consoles down due to they are known to scratch the discs but it is late so am not 100% sure.

Under the sale of goods act you are entitled to a full refund from the supplier (in this case HMV). I had an Xbox 360 for exactly 1 day before it broke. MS wanted to repair it but instead I got a full refund from Play.com who were very helpful and admitted they had been through this process quite a few times.
Don't settle for a repair, it's premium item and should function as one.

The disc's scratch if the machine is moved while still powered on, there is a useless label across the front of the draw when the machine is first unpacked warning of this issue, you can send the disc of for £2.50 to be resurfaced (using a guy on eBay), which is what I’ve had to do disc came back with a surface twice as clean and flat as what it was brand new.
Never had a problem with either my old xbox (which i've now sold on) or my elite. But the new lower power ones with hdmi I guess are still a bit unknown.0
