I am just wondering if there's anyone who can give me some advice please?

I have £20k worth of debts, with 14k with NatWest (now Zinc group) and 3k with Barclaycard (PRA Group) and the rest split between finance agreements and other cards etc.

There's 4 defaults on my credit file- 3 with NatWest (2 loans, 1 Overdraft) and 1 Barclaycard. All over now over 4 years and were registered in January 2020. The overdraft is settled.

I have put CCA requests in for NatWest and Barclaycard however they sent over statements but no actual agreement, am I right in thinking these are not CCA's?

Off the back of that I've also put affordability complaints in to NatWest as they gave me 2 loans in the space of 6 months of each other, when realistically I was already in a bad position financially. I went through a divorce and then a legal fight for my kids so costs were heavy and I tried my chance to help through that.

Affordability complaints have also gone to Capital One for 2 cards and the Very group for increasing my credit limit so rapidly.

My questions are...

 - I am struggling with the agreed repayments on all of these, I've been thinking of going through a DRO but I'm not sure if it's right for me? The reason I wouldn't want this is because me and my partner want to buy a house in future and wouldn't want to add another 6 years on top of the 4 years it's affected my file

 - The CCA's - without these, could I realistically just ignore correspondence?

 - The payments are crippling me, I could just tell them I'm paying £1 a week a that's that but just want to make sure I'm doing the right things here.

    You should only be paying what is affordable, not what they tell you to pay.

    Without a valid copy of a credit agreement the debt would be unenforceable in court, they could ask you to pay, but could not enforce their rights in court.

    Statements are not credit agreements, correct.

    Sec77/79 CCA does not apply to overdrafts.

    Don`t be afraid to lower your payments, you can enquire about a DRO, yes your credit file would be affected for longer, but you would lose the debt, its all about weighing up the pro`s and con`s here.
