Sick Pay and doctors notes

Hello 
I have been unwell for last 2 weeks and had self certified for 1st week and Doctors note for second week 
I went back to work on Monday however as very active job could not cope , spoke to Doctors who signed me off for another week including Monday 3rd ( the day I had worked ) 
My works policy is you don't get any sick pay for the first 3 days 
Because I came back for 1 day ( even though I have a sick note to cover day now ) , work have created a new sickness absense and now won't be paid for another 3 days 
I know I did come back to work as I wanted to try to get back to work , however I do have Doctors notes to cover all of the days 
Seems unfair to me that this will go down as 2 separate sickness periods ?
Not sure if there is anything I can do ?

    As far as your company sick pay is concerned it will depend on the sick pay rules of your employer, no-one can advise on that without seeing the rules.

    Regarding statutory sick pay provided that you still have entitlement then that will be payable from the first qualifying day (QD) as it will link with your previous PIW.  Your first QD is the first day of your sickness on which no work was done so if we assume you did some work on Monday the first day for SSP will be Tuesday and the count for days paid will continue from the previous PIW.  As paying company sick pay of at least the same amount as SSP counts as payment of SSP employers often show the SSP on payslips and then reduce the company sick pay by this amount; but in cases like this where you have entitlement to SSP but not company sick pay the SSP must be paid and cannot be offset against company sick pay for other days.  So if you are getting SSP for Tuesday to Friday and company sick pay for Friday then you should receive 4 days SSP but only one of those days can be included in the company sick pay. So you should receive in total one day company sick pay (includes one day SS and three days SSP plus of course your pay for any work you did.
