2nd home SDLT - replacing main residence (not married)

I have a 2nd home SDLT question and would be grateful for any help.

I own a home. My partner will have sold his soon.

We currently live in my property.

If we buy another property together, which will be our main residence, and keep my house, will we be liable for 2nd home SDLT rates? It is unclear from the HMRC website as it states:

When the higher rates do not apply

The higher rates do not apply to certain people, property and transactions.

People

Do not include anyone who will both:

  • use your new property as their main home
  • have sold or given away the last main home they owned before you buy your new home (or on the same day

    Yes you will as you fail the second condition.

    As you are not disposing of your main residence additional sdlt  will apply to the purchase of the new house in joint names.

    If your partner alone  bought it then he would not pay additional sdlt as he will only own one house.
